O DEVER DE MITIGAR OS PRÓPRIOS DANOS:
Breve análise da Convenção das Nações Unidas sobre Compra e Venda Internacional de Mercadoria em contraponto ao Ordenamento Jurídico Brasileiro

The Vienna Convention of 1980 consists of an international standard of uniform law designed to bring rules of substantive law on the International Sale of Goods, usually referred to by its english acronym "CISG". Among the institutes approached in the Convention, there is the legal figure of the duty to mitigate their own loss, which imposes on the creditor the obligation to take reasonable measures, according to the circumstances, to reduce the losses resulting from the breach of contract of the other party. The reception of the institute in Brazilian law occurred due to the doctrine and jurisprudence that, taking as reference the text of article 77 of the Vienna Convention, associated it with principles and institutes of domestic private law. It turns out that the interpretation that is given by Brazilian jurists is not always consistent with the theoretical development reached by the international community, which compromises the legal certainty expected by the actors of global trade, thus harming the sedimentation of the Convention in Brazilian territory.
