Abstract

O que significa escolher o direito aplicável na arbitragem? Na busca de responder essa questão, o presente estudo analisa a aplicação do art.42(1) da Convenção de Washington de 1965 pelo Centro Internacional para Arbitragem de Disputas sobre Investimentos (ICSID) e as diferentes questões que surgiram nos tribunais arbitrais, destacando-se: (1) o significado da escolha do direito no art.42(1); (2) a aferição da escolha implícita; (3) o papel do Direito Internacional privado e (4) o papel do Direito Internacional geral. Para tal, emprega-se a investigação dos principais awards e doutrina sobre o tema.
