CRÍTICA À PRESCRIÇÃO TRABALHISTA: ENTRE A REALIZAÇÃO DO ESTADO SOCIAL E A PROTEÇÃO AO CAPITAL

Abstract

Este artigo estabelece um estudo crítico acerca da função que a prescrição desempenha no contexto de um Estado Social. A perspectiva de análise é a dos direitos fundamentais trabalhistas. O texto propõe algumas sugestões de aplicação restritiva da prescrição no âmbito das relações de trabalho. O processo do trabalho e o direito do trabalho constituem instrumentos que servem à reprodução da sociedade capitalista. Também são, porém, fatores de tensão do sistema, permitindo que ele continue se desenvolvendo. Sob esse enfoque, a prescrição trabalhista, para que não implique negação dos direitos fundamentais do trabalhador, deve ser aplicada sempre com a máxima restrição possível.

Especialista em Direito do Trabalho e Previdência Social pela Universidade da República do Uruguai. Mestre em Direitos Fundamentais, pela Pontifícia Universidade Católica - PUC do RS. Doutora em Direito do Trabalho pela USP/SP. Pesquisadora do Grupo de Pesquisa Trabalho e Capital (USP) e RENAPEDTS - Rede Nacional de Pesquisa e Estudos em Direito do Trabalho e Previdência Social.
