Guidelines for promoting public policies to prevent domestic and family violence based on article 8 of the maria da penha law

The article aims to analyze the obstacles to the effectiveness of the Maria da Penha Law, focusing specifically on the implementation of Article 8, which provides for integrated public policies to prevent domestic and family violence against women. The central research problem is to understand why, after 19 years in force, the actions mandated by the law have not been fully implemented, with gender-based violence rates remaining high. The hypothesis is that the persistence of patriarchal structures, the fragmented performance of the State, and the emphasis on punitive rather than preventive and educational measures hinder the law’s effectiveness. To investigate this, the study adopts a qualitative methodology, based on bibliographic and documentary research. The analysis draws on legal doctrine, statistical data, official reports, and national and international legal frameworks. Concepts such as intersectionality, intersectorality, and women's human rights are used to identify implementation gaps and propose strategies to strengthen public policies aimed at combating violence.
