LEI E ARBITRIUM JUDICIS NO ANTIGO REGIME
Abstract
A investigação histórica da metodologia jurídica demonstra que ela há muito não se esgota em puras operações de lógica formal, embora isso, não raro, seja apresentado como uma característica inovadora da contemporaneidade. Essa ilusão de novidade serviu para romper e tentar superar certo positivismo, colocando-nos num tempo de transição, que ainda não se definiu com clareza, a “pós-modernidade”. Neste contexto, a lei e o arbítrio são investigados dentro da perspectiva da história do direito neste trabalho.
