RISCO DE DESENVOLVIMENTO E EVOLUÇÃO DA RESPONSABILIDADE CIVIL CONSUMERISTA NO DIREITO COMPARADO E BRASILEIRO: ANÁLISE DA INDÚSTRIA DO AMIANTO E DA SÍNDROME DE TALIDOMIDA
Abstract
O pressente estudo objetiva expor os principais elementos da “teoria do risco de desenvolvimento” trabalhada no direito comparado e afastada doutrinariamente do direito consumerista brasileiro. Analisando os fatores da sociedade de consumo e de risco, abordar-se-á a tolerância aos riscos desnecessários, o gradativo ocaso da responsabilidade civil repressiva, além da postura omissiva dos países envolvidos no tocante aos danos sociais enfrentados por diferentes gerações de pessoas, nos campos do consumo e do direito laboral. Utilizar-se-á o método de revisão literária especializada e o cotejo do direito comparado e das decisões dos Tribunais brasileiros, notadamente no âmago da Justiça Federal.
