The constitutional principle of reasonable duration of the lawsuit:a clear inefficiency in the criminal system

Abstract

The paper will initially expose the subjectivity of time to the subject inserted in the process, focusing on the criminal scope, considering the severity of the stigma and marks that are left. From this, the consequences arising from the theory of non-term adopted in the Brazilian legal system will be discussed, since article 5, item LXXVIII, of the Federal Constitution does not provide a specific time for a process to be finalized, nor much. fewer penalties if the reasonableness of the length of the proceedings is not met. This conjuncture highlights the need to adopt changes to ensure the effective application of the principle under consideration, whether in the criminal, civil or administrative context, in order to mitigate the harmful effects of this legislative gap. For a better analysis of the subject, we used the analysis of the literature already published involving the subject in focus, as well as official data published by the CNJ, which serve as evidence of the unreasonable length of proceedings in the Brazilian courts
