Anotación teóricas sobre la potestad disciplinaria de la Administración Pública

La potestad disciplinaria de la Administración Pública sobre el funcionario público resulta un tema de suma novedad en el contexto iusadministrativo cubano. Por ello, precisar sobre algunas cuestiones teóricas, a saber: aspectos conceptuales, elemento subjetivo, elemento objetivo, elemento formal y elemento teleológico; así como de su su naturaleza jurídica permite sostener teóricamente su individualidad doctrinal para poder enfrentar un estudio teórico normativo desde los distintos ordenamientos jurídicos. El artículo científico que se presenta aborda, desde las posturas y corrientes más contemporáneas en el ámbito del Derecho Administrativo Disciplinario, la potestad disciplinaria, con el objetivo científico fundamental de arribar a un concepto teórico que permita particularizar la potestad jurídica administrativa que se analiza. Para ello ha sido utilizada una metodología científica apoyada en los métodos de análisis jurídico e histórico jurídico que conjugan, desde los fundamentos históricos principales, los aspectos teóricos que permiten diferenciar la potestad disciplinaria de otras potestades o poderes disciplinarios semejantes.Downloads
