The protection of genetic data in Brazil following the scandal of appropriation of Yanomami blood

The article seeks to analyze how the case of the appropriation of the blood of the Yanomami Indians can contribute to the study, development and regulation of genetic data protection in Brazil. Advances in biotechnology, combined with the context of the information society and surveillance, have demonstrated some risks to ensuring fundamental rights arising from the protection of ultra-sensitive personal data. To this end, the research will analyze the case of the non-consensual appropriation of genetic data in Yanomami blood by North American researchers, in the 60s and 70s, in the context of biotechnological evolution. The analysis of the case will serve to study the right to protection of sensitive data in Brazil. Through the inductive method and the bibliographical research technique, it was realized that the regulation of data protection in Brazil has been of great relevance for guaranteeing the fundamental right to privacy, as well as for the necessary protection of genetic data, especially of original populations.
