a thinker among independences and constitutions

This article aims to study the constitutional thought of Frei Joaquim do Amor Divino Caneca within the context of the political turmoil in Pernambuco from 1822 to 1824. Throughout these years, the author played a prominent political role through the publication, discussion, and defense of his ideas in Pernambuco's political landscape. The research follows a bibliographical review of Brazilian historical and constitutional literature, analyzing primary sources such as official manuscripts and pamphlets, interpreted according to the history of concepts and historical contextualism. The article addresses the author's role in developing a constitutional and republican culture in Pernambuco; examines the debates aroung the moderating power; and explores concepts such as republic, confederation, and constitution from Caneca’s perspective. It also adresses the precedents of the 1824 revolution, the conflict between the Courts of Lisbon and the Court of Rio de Janeiro, and the continuities and ruptures after the granting of the Brazilian Constitution. Throughout his political trajectory, Caneca consistently defended the substance of the Constitution over its form. He argued that the social contract should be voluntary, legitimized by the sovereign will of the people, advocating that provinces were free to adopt the new Constitution or not. Contrary to the Coimbra elite, he criticized the assignment of legislative functions to the Emperor and rejected the idea of a strong executive power. Caneca was instrumental in developing the theoretical foundations of the Confederation of the Equator and in redefining the concepts of Republic and Federation in Brazil.
