A justiça de fora parte – indivíduos, tribunais e usos da norma em PE no século XVIII
Abstract
Resumo: Durante todo o século XVIII há registros da atuação de uma justiça local em Pernambuco. A presença de juízes de fora e de seus auxiliares, além da delimitação das comarcas e juízos corresponderam a um novo momento no qual o dizer do direito e o fazer da justiça passaram a ter nome e lugar, além de, em teoria, absorver representantes mais profissionais na América Portuguesa. Neste artigo nos propomos a discutir as condicionantes e os desdobramentos dessa justiça numa situação local. Para tanto, abordamos alguns recortes da implantação dos institutos da nova ordem jurídica em Pernambuco e historicizamos algumas práticas fragmentadas de um dos sujeitos que faziam parte dela no século XVIII.
