Decent housing and preservation of architectural modernism in the city of Recife: a brief analysis of the administrative omission in the Holiday Building

The constitutional text, with the emergence of the Welfare State, assures all citizens the right to housing and the protection of their heritage, as provided in Articles 6 and 216 of the Federal Constitution of 1988, res-pectively. Such obligations impel the public power to work actively for the promotion of housing with dignity and for the conservation of the cultural-historical heritage, being certain that any omission by the gover-nment will result in flagrant breach of the constitutional dictate. In this sense, this article aims to understand the situation in which the Holiday Building, a landmark of Pernambuco’s modern architecture, finds itself, from a legal perspective of state responsibility. To this end, bibliographic and documentary research were used as a basis. It is concluded that the situation of the Holiday Building represents a symbolic attack on the right to decent housing and on the cultural heritage of Recife’s population, since the state entity failed, over the years, to take the appropriate measures to safeguard both housing and the cultural asset.
