The banalization of evil and human rights: a hermeneutic phenomenological reading in Paul Ricoeur

Abstract

This text intends to discuss, based on bibliographic and documentary research, the recurrent theme of rights, in view of the trivialization of evil and the problem of so-called deficient legal humanism, from a hermeneutic-phenomenological grounding in Paul Ricoeur. In this sense, it launches the fundamental notion of an anthropology of the "who", as a reference point for the effort of structural reconstruction of the so-called capable subject, while someone who speaks, acts, narrates and responds, besides being worthy of esteem and respect, with openness to the horizon of interpersonal and institutional relations, in which recognition, reciprocity and justice are manifested, until the real subject of the right is reached. Not a virtual, but a real subject of law, nodded, backed as a person for human rights, since he holds natural and indistinct of these exponential and non-negotiable rights. At last, human rights, individual and social, can be preserved, and are at risk of perishing, if not well taken care of, with freedom and responsibility, both by their holders, as well as by the institutions charged of mediations and guarantees of these rights.
