The PSYCHIATRIC REFORM IN THE EXECUTION OF SENTENCES:
THE IMPLICATIONS OF THE CLOSURE OF CUSTODY HOSPITALS IN PERNAMBUCO
Abstract
This study aims to address the implementation of security measures following the Psychiatric Reform in Brazil, with a particular focus on the factual context of the state of Pernambuco. Given the tragic history associated with asylums and the legislation pertinent to the issue, it is evident that the Anti-Asylum Policy is still undergoing a transitional process within the Judiciary, despite Law No. 10.216 of 2001 having mandated the closure of such institutions over two decades ago. Regarding the methodology employed, this study is descriptive in nature and adopts a bibliographic and documentary approach, based on the deductive method. As for the research procedure, the analysis was conducted through a review of scientific articles found in databases such as CAPES Journals and SciELO, as well as publications from university journals accessed via Google Scholar. In addition, relevant legislation at both national and state levels was examined, along with case law from the Federal Supreme Court and information available on official government websites, including gov.br and the Pernambuco State Government, particularly the State Department of Health. Based on the reviewed literature, it is evident that the implementation of the Anti-Asylum Policy is both urgent and necessary. However, due to ongoing delays, rather than closing the custodial and psychiatric treatment hospitals altogether, it may be more feasible to maintain and adapt them in accordance with the 2001 Psychiatric Reform Law.
