A INTERPRETAÇÃO DAS LEIS REAIS: AMBIGÜIDADE E PRUDÊNCIA NO PODER DAS AUTORIDADES LOCAIS NA AMÉRICA DO SÉCULO XVI
Abstract
Neste artigo procuro mostrar como a interpretação legislativa, realizada por juristas e teólogos que moravam há tempos na América era uma das formas que as esferas de poder locais podiam utilizar para defender os seus próprios interesses, negociando, transigindo ou
se adaptando às necessidades e circunstâncias concretas, invocando freqüentemente a sua própria consciência e as determinadas condições em que a sociedade local se encontrava. Tentarei por meio da comparação do texto da Apologia pro Paulistis (1684) com o “Tratado que contiene tres pareceres graves en Derecho”, de Fray Miguel Agia, publicado
em Lima, em 1604, discutir o papel da interpretação hermenêutica, mostrando como as autoridades coloniais podiam não apenas executar ou adaptar as leis reais, mas também modificá-las, ignorá-las ou, mesmo, desobedecê-las, sem, por isso, se constituírem num núcleo de oposição ou de desobediência à Monarquia.
